Exchanges & Returns

The Botanical Family does not offer any exchange or returns at this time. Once (you) a customer has purchased your item, it is yours. We want to make sure you are completely happy with your purchase and encourage you to read reviews and use our Contact page in order to make the right selections before purchase.

If your item gets lost in transit, it is the customers responsibility to contact the USPS to find their order. Orders over $34 will receive $50 shipping insurance which is your responsibility to retrieve if the item is lost. The Botanical Family Inc., will do what we can to help guide you, but once it leaves our facility, it is the responsibility of the USPS, and no longer under our care or responsibility. It is also up to you, the customer, to ensure the correct address is entered when we ship this out to you.

Giveaway and contest items are not eligible for returns, credits, or exchanges.

Contests & Giveaways

Our contests and giveaways are done by our discretion only.
We reserve the right to refuse a giveaway item to a winner.
Contest winner will be held responsible for the shipping costs for their giveaway item.
We are in no way responsible for errors on the winners part in shipping address mistakes or any other mistakes through the checkout process. Please double check your input.

Shipping

Here at The Botanical Family (thekratomfamily.com), we want to be able to ship your item out as quickly as possible. However, there may be cases where we are behind in shipping. Customer will receive a tracking number by email once shipping has processed. You are responsible for providing the correct shipping address on the checkout page. Our shipping label software will print whatever shipping address you provide upon checkout. Once your item begins the shipping process, it is no longer The Botanical Family Inc.’s property, nor are we responsible for any losses, damages, or USPS “Return to Sender”. Please use the tracking number provided and talk to your local post office for any help regarding your package. The Kratom Family does try to ship your order out the same day, however, we cannot guarantee this. We ship Monday through Friday and we are on Eastern Standard time. We do not ship on Saturdays or holidays.

Our products are not for use by or sell to persons under the age of 18. We do not ship to the following areas where Kratom is banned: Alabama, Arkansas, Indiana, Rhode Island, Vermont, Wisconsin, Sarasota County, Union County, Malheur County, Denver, CO., San Diego, CA., City of Oceanside, CA., Jerseyville, IL., Alton, IL., & Columbus, MS. We do not ship outside of the United States.

The Botanical Family Inc., performs rigorous lab-testing on all of our Kratom powder products. These tests ensure we are providing a pure plant that is safe and all-natural. Our lab testing reports are tested in batches and we have each individual batch lab report for your viewing pleasure. Affiliate Terms of Use

As an authorized affiliate (Affiliate) of The Botanical Family, Inc., you agree to abide by the terms and conditions contained in this Agreement (Agreement). Please read the entire Agreement carefully before registering and promoting The Botanical Family, Inc. as an Affiliate.

Your participation in the Program is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to The Botanical Family, Inc. by your own website or personal referrals.

By signing up for the The Botanical Family, Inc. Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

Approval or Rejection of the Application

We reserve the right to approve or reject ANY Affiliate Program Application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

Commissions

Commissions will be paid once you reach a threshold of $100 to an active Paypal account. For an Affiliate to receive a commission, the referred account must remain active for a minimum of 31 days. Their Paypal account email must also be in good standing. Otherwise we reserve the right to refuse payment.

You cannot refer yourself, and you will not receive a commission on your own accounts. If so, you will be kicked from the program and banned from the site.

Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

Termination

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
Spamming (mass email, mass newsgroup posting, etc.).
Advertising on sites containing or promoting illegal activities.
Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
Violation of intellectual property rights. The Botanical Family, Inc. reserves the right to require license agreements from those who employ trademarks of The Botanical Family, Inc. in order to protect our intellectual property rights.
Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive. Adding bonuses or bundling other products with The Botanical Family, Inc., however, is acceptable.
Self referrals, fraudulent transactions, suspected Affiliate fraud.

In addition to the foregoing, The Botanical Family, Inc. reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason.

Affiliate Links

You may use graphic and text links both on your website and within in your email messages. You may also advertise the The Botanical Family, Inc. site in online and offline classified ads, magazines, and newspapers.

You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in the Termination section.

Coupon and Deal Sites

The Botanical Family, Inc. occasionally offers coupon to select affiliates and to our newsletter subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:

Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.
Affiliates may not bid on The Botanical Family, Inc. Coupons, The Botanical Family, Inc. Discounts or other phrases implying coupons are available.
Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.
User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).
Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.

Pay Per Click (PPC) Policy

PPC bidding is NOT allowed without prior written permission.

Liability

The Botanical Family, Inc. will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).

We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by The Botanical Family, Inc.. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.

Term of the Agreement

The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.

The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

Indemnification

Affiliate shall indemnify and hold harmless The Botanical Family, Inc. and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by The Botanical Family, Inc. to transmit and distribute materials, from any and all claims, liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate. Including (a) your breach of these Terms; (b) your unlawful access to or unlawful use of this website or its products; (c) your unreasonable use of, reliance on, or publication, communication or distribution of anything on or from this website or its products; (d) your violation of city/state banning laws that prohibit you or any other customer from sending, transporting, or sharing Kratom tea across state/city lines where this product is in violation of the law; (e) use our product with ANY prescription medication, over the counter medicine, or supplements. We prohibit any other use of any substance while using Kratom and have stated as such on our bags and as a customer, you are bound to follow these restrictions. We follow the letter of the law and justice system and prohibit any illegal activity, such as sending these products knowingly to another address where this product is legal so customers can transport it across state/city lines where it is illegal. You shall use your best efforts to cooperate with us in the defense of any claim and waive your rights against Botanical Family, Inc in the case where you have broken this agreement, we reserve the right, at your own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You, as a customer, are bound by these terms and agreements, and fully and completely release Botanical Family, Inc from any responsibilities in any situation in your medical case. By clicking “I Agree to the Terms” at checkout, you relinquish your rights to any lawsuits, monies, or judgement made against this company, it’s directors, president and vice president as stated in these Terms.

Electronic Signatures Effective

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the The Botanical Family, Inc. affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the The Botanical Family, Inc. application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
